Homeward Terms of Service
1. Acceptance
By creating a Homeward account or using the Homeward app, you agree to these Terms of Service ("Terms") and the Privacy Policy. If you do not agree, do not use the app.
Homeward is operated by Nick Arning, sole proprietor, based in Basel, Switzerland. Pre-validation, Homeward is a personal project — not a registered company. Post-validation a Swiss GmbH may be formed (per Operating Principle #6); these Terms are updated when that happens.
2. Eligibility
You must be 16 years of age or older to use Homeward. We do not knowingly accept users under 16. By using Homeward you represent that you are 16 or older. See Privacy Policy § 10 for our children's-data position.
3. What Homeward is
Homeward is a local editorial discovery app. We select and maintain outing plans, walking routes, and event suggestions for going outside, meeting up with the people you care about, or self-treating with a handpicked experience. The going-as model supports five modes: solo, with a partner, with friends, with parents, with family. Per Operating Principle #11 (location-lite by design), Homeward never collects device location — city selection is explicit; navigation hands off to your installed Maps app.
What Homeward is NOT:
- Not a dating app. Homeward v1 has no profile-matching, no swipe mechanics, no in-app messaging between strangers. Our App Store metadata explicitly avoids "dating" / "matching" / "relationship" vocabulary.
- Not an advertising platform. Per Operating Principle #14 (honest monetization), Homeward does not sell ads, does not sell user data, and does not host promoted content.
- Not a traditional social network in the feed-and-follower sense. Homeward has a minimal optional follow system (approve-required, private by default, no activity feed, no follower counts, going-dark mode available) per Operating Principle #17 (social-lite by design). There is no in-app messaging, no public profile by default, no follower-count pressure, no broadcast-by-default.
- Not a marketplace. Homeward does not facilitate transactions between users; we are not a payment processor.
4. Your account
You are responsible for safeguarding your username, password, and the one-time recovery code shown to you at account creation. There is no email-based password-reset path (Homeward never asks for your email address — see Privacy Policy § 2). If you lose your recovery code and forget your password, account recovery may not be possible. Keep your recovery code somewhere safe. You are responsible for all activity under your account. Notify us at security@gethomeward.app if you suspect unauthorized access.
You may have only one account per person. Multiple-account abuse (rating manipulation, spam) is grounds for suspension or termination.
5. Content you contribute
When you submit ratings, tips, or photos to Homeward, you grant Homeward a worldwide, non-exclusive, royalty-free license to use, display, and distribute that content within the app and on the Homeward marketing site, for the purpose of operating and promoting the service. You retain ownership.
You represent that:
- The content is your own (or you have explicit permission from the rights holder).
- The content does not violate any third party's privacy, IP, or other rights.
- Photos do not include identifiable people (faces or other identifying detail) without their consent. Bystander privacy is a community guideline — if a stranger is identifiable in your photo (face visible, identifying tattoo, name tag), get their okay or crop them out, and never photograph children who are not your own without explicit parental consent. See the Community Guidelines for the full statement of these rules; they are binding under these Terms regardless.
- You have not used AI-generated content to fabricate ratings, photos, or tips. Per Operating Principle #3 (authenticity over scale), Homeward does not accept fake user content; submission of AI-generated user-content is grounds for content removal and account suspension.
6. Acceptable use
You agree NOT to:
- Submit content that is illegal, harassing, hateful, threatening, defamatory, obscene, or designed to deceive.
- Submit fake ratings, fabricated tips, or AI-generated user-content (Operating Principle #3 enforcement).
- Submit photos with identifiable bystanders without their consent (per § 5 above).
- Scrape, copy, or systematically extract content from Homeward without our written permission.
- Reverse-engineer or attempt to extract source code from the app.
- Use Homeward to send spam, phishing, or other unsolicited communication.
- Impersonate another person or entity.
- Use Homeward's API or backend in any way not explicitly authorized.
- Attempt to circumvent rate limits, RLS policies, or other technical safeguards.
- Use Homeward in violation of Swiss law or applicable EU law (including GDPR + AI Act).
7. Reports and moderation
- Any user can report another user's content via the in-app reports flow. Categories include: bystander privacy violation, fake content, harassment, spam, illegal content, copyright, off-topic, other.
- We aim to respond to reports within 48 hours (the broader report-handling SLA target — see the Community Guidelines § 4 for the 24-hour content-moderation target specifically). The in-app reports view shows you the status of reports you've filed.
- We may remove content, suspend accounts, or terminate accounts that violate these Terms or the acceptable-use rules in § 6.
- We are NOT obligated to monitor all content proactively; we act on reports.
- Do not file false reports. Repeated false-reporting (using the reports flow to harass other users) is itself a violation of these Terms.
8. Account termination
You may delete your account at any time in app settings. Per our Apple 5.1.1(v) compliance path:
- Deletion is two-stage: 30-day grace period (account suspended; restorable) + hard delete via cron with anonymization.
- After hard delete, your username, password hash, recovery-code hash, and personal data are removed; ratings/tips you authored are anonymized (text retained for community value, user_id nulled). No email address was ever stored; there is nothing to remove on that front.
- Photos are deleted from storage on hard delete.
We may suspend or terminate your account if:
- You violate these Terms (including the conduct rules in § 5 + § 6).
- We are required by law or regulator action.
- We discontinue Homeward (per § 13).
We will give reasonable notice except where notification would defeat enforcement (e.g., active investigation of fraud).
9. Intellectual property
The Homeward app, marketing site, content (template prose, editorial writing, illustrations, brand identity), and source code are owned by Nick Arning (or post-validation, the Swiss GmbH that succeeds the sole-proprietor entity). You may not copy, modify, or redistribute without written permission.
User-contributed content (ratings, tips, photos) remains owned by the contributing user, subject to the license in § 5.
10. Disclaimer of warranties
Homeward is provided "AS IS" without warranties of any kind, express or implied, to the maximum extent permitted by Swiss + EU law. We do not warrant that:
- The app will be uninterrupted or error-free.
- Editorial recommendations will match your taste or interests.
- Third-party places (restaurants, museums, parks) will be open, available, or as described — Homeward describes places at the time of editorial walk; conditions change.
- Hand-off to Google Maps / Apple Maps will route you correctly — those are third-party services under their own Terms.
11. Limitation of liability
To the maximum extent permitted by Swiss + EU law, Nick Arning (and any successor entity) shall NOT be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of Homeward, including but not limited to:
- Personal injury during an outing (Homeward is editorial; the user is responsible for their own safety).
- Loss of data, profit, or business opportunity.
- Third-party service outages (Supabase, Google Maps, Cloudflare, etc.).
- Bugs, crashes, or service interruption.
Aggregate liability for direct damages is capped at the amount you have paid to Homeward in the 12 months preceding the claim (which, while Homeward is free to use, is CHF 0).
This limitation does NOT apply to:
- Damages caused by gross negligence or willful misconduct.
- Mandatory consumer-protection rights under Swiss / EU law.
- Mandatory data-protection liability under GDPR / FADP.
12. Governing law and jurisdiction
These Terms are governed by Swiss law, excluding conflict-of-laws principles. Disputes are subject to the exclusive jurisdiction of the courts of Basel-Stadt, Switzerland, without prejudice to mandatory consumer-protection forum rules under EU law.
If you are an EU consumer, you may also lodge complaints via the European Commission's online dispute resolution platform (ec.europa.eu/consumers/odr).
13. Discontinuation
Homeward is built nights-and-weekends per Operating Principle #7. We reserve the right to discontinue the service at any time, with reasonable notice (at least 30 days; longer for any future paid-tier users). On discontinuation, we will provide an export of your data per Privacy Policy § 6.
14. Changes to these Terms
We may update these Terms. Every change requires a decision-log entry. Substantive changes (data rights, liability, fees) trigger a notification to active users with at least 14 days' notice before effect.
